货拉拉平台“相应责任”的法律适用

摘要

厘清货拉拉平台审核与安全保障义务和责任，需要对《电子商务法》第38条第2款进行解释。司机与平台若构成劳动、雇佣等用工关系，单独侵权或是与第三人共同侵权，仅依据侵权责任编认定责任承担，无须适用第2款；构成居间合同，若平台未尽到基本审核与安全保障义务则与司机承担连带责任；未尽到非基本义务，则对司机承担适当比例的补充清偿责任。

Abstract

To clarify the audit and security obligations and responsibilities of the cargo LaLa platform,it is necessary to explain paragraph 2 of Article 38 of the e-commerce law.If the driver and the platform constitute labor ,employment and other employment relations,and infringe alone or jointly with a third party ,the liability shall be derermined only according to the tort liability series,and paragraph 2 does not apply;Constitute an intermediary contract .If the platform fails to fufill its basic audit and safety guarantee obligations ,it shall bear joint and several liabilities with the driver ;if it fails to fufill its non basic obligations,it shall bear an appropriate proportion of supplementary repayment responsibilitise to the driver.
