本文以数字经济发展为背景，聚焦知识产权保护与数字贸易的互动关系，通过系统剖析二者的互动机制与现实困境，提出协同发展对策。研究发现，知识产权保护与数字贸易呈双向互动关系：一方面，知识产权保护通过构建制度保障、激励创新供给、降低市场分割，为数字贸易发展奠定基础，形成“保护-创新-贸易”的良性循环；另一方面，数字贸易通过拓展保护边界、推动规则优化、强化国际协调，倒逼知识产权保护体系完善，形成“贸易发展-需求升级-制度完善”的动态演进。
Based on the background of digital economic development, this paper focuses on the interactive relationship between intellectual property protection and digital trade. Through literature research and normative analysis, it systematically analyzes the interactive mechanism and practical difficulties between the two, and proposes countermeasures for coordinated development. The research finds that intellectual property protection and digital trade have formed a two-way interactive mechanism: on the one hand, intellectual property protection lays the foundation for the development of digital trade by establishing institutional guarantees, stimulating innovation supply, and reducing market segmentation, forming a virtuous cycle of “protection - innovation - trade”; on the other hand, digital trade prompts the improvement of the intellectual property protection system by expanding protection boundaries, promoting rule optimization, and strengthening international coordination, forming a dynamic evolution of “trade development - demand upgrading - system improvement”.
