Copyright infringement risks and regulatory approaches for Chinese animated films going global: Evidence from Ne Zha: The Devil’s Sea
动画电影出海的版权侵权风险与治理路径——以《哪吒之魔童闹海》为例

摘要

当前，随着动画电影出海的蓬勃发展，版权侵权问题不断凸显，进一步加强动画电影出海的版权治理已然势在必行。本文以《哪吒之魔童闹海》为典型案例，采用文献研究与案例分析法，系统梳理我国动画电影出海面临的传统侵权产业化、AI侵权隐蔽等风险，深入剖析侵权行为对文化符号传播、价值观认同及文化国际话语权的多重负面影响。研究发现，当前跨境版权治理存在国际规则滞后、执法协作不畅、企业布局滞后、行业协同薄弱等困境。据此提出构建政府主导、行业协同、企业主体、国际合作的多元治理体系，为中国动画电影出海版权保护提供实证参考与路径支撑。

Abstract

At present, with the vigorous development of animated films going global, the issue of copyright infringement has become increasingly prominent, making it imperative to further strengthen copyright governance for animated films going global. Taking Ne Zha: The Devil King Havoc in the Seas as a typical case, this paper adopts the methods of literature research and case analysis to systematically sort out the risks faced by China's animated films going global, such as the industrialization of traditional infringement and the concealment of AI infringement, and deeply analyzes the multiple negative impacts of infringement acts on the communication of cultural symbols, the recognition of values and the international discourse power of culture. The study finds that the current cross-border copyright governance is confronted with dilemmas including outdated international rules, inefficient law enforcement cooperation, lagging corporate layout and weak industry coordination. Accordingly, it proposes to construct a diversified governance system led by the government, coordinated by the industry, dominated by enterprises and supported by international cooperation, so as to provide empirical references and path support for the copyright protection of Chinese animated films going global.
