网络暴力现象的法律规制困境与治理策略研究

摘要

随着互联网的迅猛发展，网络暴力现象愈发严重，给社会秩序和个人权益带来了严重威胁。本文围绕网络暴力的法律规制困境与刑事治理路径展开研究，揭示现行法律体系在应对网络暴力时的局限性，如“法不责众”现象以及对网络暴力行为缺乏明确的法律界定。文章探讨了多元主体在网络暴力中的责任，并分析了法律与网络平台之间的治理关系。针对法律规制的不足之处，提出需建立完善的法律框架，包括设立《反网络暴力法》，明确新型网络暴力行为的法律责任。同时，建议强化平台的监管责任，创新治理机制，以应对复杂的网络暴力现象。通过理论分析与实践探讨，旨在为完善网络暴力的法律治理提供切实可行的路径，促进形成和谐健康的网络环境。

Abstract

With the rapid development of the Internet, the phenomenon of online violence has become increasingly serious, posing significant threats to social order and individual rights. This paper focuses on the legal regulation challenges and criminal governance approaches to online violence, revealing the limitations of the current legal system in addressing online violence, such as the 'law does not punish the masses' principle and the lack of clear legal definitions for online violent behaviors. The article explores the responsibilities of multiple actors involved in online violence and analyzes the governance relationship between the law and online platforms. To address the deficiencies in legal regulation, it proposes the establishment of a comprehensive legal framework, including the enactment of an "Anti-Online Violence Law" and clarifying the legal responsibilities for new forms of online violence. Meanwhile, it recommends strengthening platform regulatory responsibilities and innovating governance mechanisms to respond to complex online violence phenomena. Through theoretical analysis and practical discussion, the aim is to provide feasible pathways for improving the legal governance of online violence and to promote the formation of a harmonious and healthy online environment.
