摘要

本文探讨运用庭审视频约翰尼·德普诉艾梅伯·希尔德诽谤案培养涉外法治人才“事实建构能力”的方法。作者认为,在实务导向的涉外法治人才培养中,建构清晰、可信事实叙事的能力十分重要。通过分析双方律师的开庭陈述对比,文章阐释了有效事实建构的关键技巧如基于事实进行合理推论,构建符合受众认知模板的连贯故事并巧妙处理不利事实(如置于特定背景)。运用真实庭审视频教学能使学生直观感受叙事力量、实务能力差距及非法律因素在诉讼中的关键作用,从而激发职业荣誉感,提升综合实务素养。

Abstract

This article explores the method of using the trial video of Johnny Depp v. Amber Heard defamation case to cultivate the "factual construction ability" of foreign-related legal talents. The author believes that the ability to construct clear and credible factual narratives is crucial in the cultivation of practical-oriented foreign-related legal professionals. By analyzing the court opening statements of both lawyers, the article explains the key techniques for effective fact construction, such as making reasonable inferences based on facts, constructing a coherent story that conforms to the audience's cognitive template, and cleverly handling unfavorable facts (such as placing them in a specific context). The use of court trial video teaching can enable students to intuitively feel the narrative power and the key role of non-legal factors in litigation, thereby stimulating a sense of professional honor and enhancing practical literacy.
