行政裁量权基准制度研究

摘要

行政裁量权基准是行政机关行使自由裁量权的重要依据，贯彻着行政执法的全过程和各方面。科学严格执法关系到全面依法治国的战略全局，是推进社会主义法治建设必不可少的方面。过分放大行政机关的自由裁量权会导致权利膨胀，损害人民权益。若极度限缩行政裁量权，则会造成行政效率低下，不利于政府工作的进行。我国行政裁量基准在制定和实施过程中尚存在不足之处，科学合理地限定行政裁量权，明确裁量基准制定的主体和程序，健全裁量基准实施的监督保障机制对于我国法治建设有着重要意义。

Abstract

Administrative discretion benchmarks serve as crucial guidelines for government agencies to exercise discretionary powers, permeating all aspects of law enforcement. Scientific and rigorous law enforcement is vital to the strategic goal of governing the country according to law, forming an indispensable component in advancing socialist rule of law. Excessive expansion of administrative discretion may lead to power inflation and infringement of public rights, while overly restrictive measures could result in administrative inefficiency that hinders governmental operations. Current shortcomings exist in China's formulation and implementation of administrative discretion benchmarks. Establishing scientifically sound parameters for discretion, clarifying responsible entities and procedural frameworks for benchmark creation, and improving supervisory mechanisms for implementation are of paramount importance for advancing China's legal system.
