摘要

本文聚焦于《产品质量法》中“缺陷”概念的立法重构展开深入探讨。在当前法律体系框架内，“缺陷”概念的界定存在着很多模糊地带，这种不确定性在司法实践当中引发了很多操作难题。为顺应新时代对产品质量监督管理提出的要求，本文对“缺陷”概念进行了精确界定与深度细化。通过明确概念内涵与外延，有效提升了立法条款的可操作性。与此同时，本文充分借鉴国外在产品质量监管领域的先进经验，构建了一套科学、合理且具有可操作性的“缺陷”认定制度。这一制度的建立，有助于从源头上提升我国产品质量与安全水平，切实保障消费者的合法权益，推动《产品质量法》不断完善与发展，在理论与实践层面均具有重大而深远的意义。

Abstract

This paper delves into an in-depth discussion on the legislative redefinition of the concept of "defect" in the Product Quality Law. Within the current legal framework, there are numerous ambiguities in the definition of the "defect" concept, and this uncertainty has led to many operational challenges in judicial practice. To meet the requirements for product quality supervision and management in the new era, this paper precisely defines and thoroughly elaborates on the concept of "defect". By clarifying its connotation and extension, the operability of legislative provisions is effectively enhanced. Meanwhile, this paper fully draws on the advanced experiences of foreign countries in the field of product quality regulation to establish a scientific, reasonable, and operable system for identifying "defects". The establishment of this system is conducive to improving the quality and safety standards of China's products from the source, safeguarding consumers' legitimate rights and interests, promoting the continuous improvement and development of the Product Quality Law, and holds significant and far-reaching implications in both theoretical and practical aspects.
